"engaged in the business" does not have a quantity. If you sell 40 in a lot I'd say it would be a non issue. Selling off a collection or trying to stay out of financial ruin.
Flipping 40 guns one by one would raise a flag, IMO
Some snips from what may be going in as a new ruling is any profit. The way it's worded it may be illegal to trade up, even though cash is not involved. I also read where if you buy a gun you can't sell it within a 30 day period. How much or how far they want to dive in all depends I guess. I don't want to be stuck with some of the stuff I've outgrown, but it ain't worth risking getting rid of it for 500 and end up in prison. I like my king size bed.

If you word your ads appropriately, something like “this firearm is from my personal collection, and I am selling it at a financial loss due to health reasons”, you should be fine.

I took some time to read through most of this. Gotta love the tactic of reprinting the history of the world IOT throw everyone off. The one thing that really stood out was the use of the word "intent."
Words matter. It's way easier to prosecute/convict intent than actual deeds. That's what's happening to trump right now.
