Here is his response to my email regarding red flag laws:

Thank you for contacting me regarding the recent tragedies in Dayton, Ohio and El Paso, Texas. I appreciate the opportunity to respond. Tragedies like these are devastating, not only to the communities and loved ones impacted, but also to families across the nation as we grieve with them and keep them in our prayers.

The safety of our families is always my top priority, and I am a proud supporter of the Constitution, the Second Amendment and the rights of law-abiding citizens. As we work to move forward, I am committed to reviewing proposals that work to keep Americans safe. As Governor of Florida, I worked to increase safety measures in Florida’s schools through the Marjory Stoneman Douglas High School Public Safety Act. We also passed a “red flag” law in the state of Florida, commonly referred to as an Emergency Risk Protection Order (ERPO). When properly constructed, red flag laws are a common sense measure to keep weapons out of the hands of any person who threatens to harm themselves or others, or who is mentally unstable.

As United States Senator, I remain focused on making sure that our schools and communities are safe, and that those struggling with mental health issues or threatening harm to themselves or others cannot use a weapon. I am currently working with my colleagues to pass the EAGLES Act (S. 495), which provides law enforcement more resources to prevent tragedies and improves school safety for students and teachers. I am also a cosponsor of the Threat Assessment, Prevention, and Safety (TAPS) Act (S. 265), which will create a task force of experts to provide recommendations for a national strategy to keep communities safe from targeted violence.

Again, thank you for your correspondence. I am proud to represent every citizen in Florida and I appreciate the time you took to provide your position on this matter. Should you have any additional questions, please feel free to contact me.

    Sincerely,

    Rick Scott
    United States Senator

I hope the OP used a "junk" e mail address because just as sure as God makes little green apples, the e address you used is being given to every Republican congressman and Senator and that e address is going to receive untold amounts of e mails saying they need your support to keep fighting the good fight on your behalf

This is the same man who while governor signed off on multiple budgets and laws that defunded or reduced state funding for public mental health services.

Sometimes I wonder if we were better off with Bill Nelson. At least Bill was open and consistent.

We need better "choices" in the Primaries! Once it gets to the general elections it a clear us or them decision.

WATCH TAPS! It creates a temporary think tank to develop/recommend (among other things) Threat/Risk "Line in the Sand". States professions for primary members from the usual Agencies but not on slot for Civil or Constutional Rights Scholar/expert/lawyer. Are these Threats: a guy that multiple ARs, a Prepper that has a dozen loaded mags, a person that tells his boss or neighbor to f#<k off and die, a person that calls the actions of gov Tyrannical, most speech from keyboard commandos?

Scott is trying to do the right thing IMO. I know most don't like the Red Flag Laws for their ability to be abused by family members but what would everyone suggest be done to stop people with mental health issues from committing mass murders? Rather than come after law abiding citizens guns he's pushing for mental health reform which is what is needed. Blast me for this but seriously, where does the line stop between preventing these mass murders by taking guns from people with mental health issues who pose a threat and taking the guns away from law abiding citizens? What is everyone's grand plan if the red flag laws aren't the solution?

Except it's an issue that isn't an issue. If you look at the numbers during the AWB of 94-04 we averaged just over 2 mass shootings per month. During Obama's years we averaged 1.625 a month, so far during current administration it's at 1.5 per month. Obviously keeping evil guns from people didn't work very well.

For Mental Health based Red Flags why wasn't the 72 Hour Mental Health Hold & Eval good enough? Its already on the Books. One stop shopping. Oh, it doesn't instantly deprive a person of his/her firearms or leave people on the Street so they can use other devices to harm tbemselves or others like Red Flag Laws do!

This is exactly why Red Flag Laws will not be effective for mental Health issues. Takes one type of tool and leaves everything else. Has no provision for initiating anything regarding mental health, takes guns because person is a "danger" to self or others but leaves person unsupervised where the person can act in other ways to endanger self or others and ZERO follow up from authorities. It only provides a proceedure to take firearms and doesn't address the problem of WHY it was done.

"Red Flag" Laws are GUN CONTROL. They are NOT mental health assistance. They are NOT crime prevention. They are NOT mass-murder prevention.

My solution to stop people from commiting mass murders in public? Responsibly-armed Citizens. As many as possible.
You can never eradicate evil, but you sure as hell can fight it and reduce it.

    I wouldn't sweat it...
What's in the works is far more devious and overwhelming.
Have you heard about the Military's replacement for the SAW??
    Most folks haven't...
But here's the dawg that'll bite...
6.8mm plastic cased ammo., fully enclosed round.
WILL NOT BE available for Civilian Resale.
And the M4 platform is being changed to run it as well.

    So what does that mean??
Lots of M16 & M4's being melted down...
    or sold to foreign gov'ts...
But the real catch...watch for AMMO MFR's to start taking hits on EPA
and other regulations...they already stopped LEAD mines in the USA...
so watch for Brass to start being more regulated...
watch for Ammo MFR's to start getting more hits...
So if you weren't already reloading, better start soon...
or you won't be able to feed your guns.
Best stock up on brass while yer at it...

And you remember they were talking about making Powder have an expiration...
so folks can't store bunches and make ammo whenever they feel...
and amount of powder one can store is going to be legislated as well...
    already happened in Cali.

In short...we're already screwed. It's just a matter of how long we can keep Republicans as a majority in the Senate and Presidency as to how long we'll be able to enjoy shooting sports...bottom line, if all three (House/Senate/Prez) are Dems, watch for the 2nd to go Bye Bye. Make no mistake about it though...they're planning on getting rid of our guns one way or the other...by Planned Obsolescence. By hook or by crook, in other words.

Because the 72-hr Baker Act has no teeth.
The Patient can simply WALK OUT at any point...
and NOBODY can do ANYTHING physical to stop them...
or they can be charged with Kidnapping.
Can't even place them in a hard-locked room.
All you can do is call the fuzz, they'll recapture and return them,
at that point the cop will usually hang out until a Psych can see them...
then Psych can admit them...or declare them OK and release.

Bottom line, the Baker Act is dang near useless.
Upside, if the patient is nuts, they usually can't figure out that
they CAN just get up and walk out.

No one seems to see the HARM this can do.

Communists want our guns. And, historically, the way they got them was when they got in power they (the state) deemed anyone who wasn't in agreement with them and their policies as "Mentally unstable." And, then they took their guns, and locked them up.

This is indeed a "slippery slope." Give a man the power to legally declare a person "mentally unstable" and you have given a DICTATOR or a TYRANT the tools he needs to destroy his political enemies and get rid of them. For all he has to do is declare everyone who's against HIM and his political ideology is mentally unstable.

The are called "RED FLAG" laws for a reason. Don't communists have a red flag? HMMMM.

Here's the issue, guys. Plain and simple. The bill of rights is a bill of "GOD-GIVEN" rights. The second amendment, according to our forefathers, was not GOVERNMENT allowing us to have guns. It was recognizing that GOD gives us the right to own firearms.

The problem is commies want to kick out God and set up the state as God. What happens when commies take over? They KILL PEOPLE with the very guys they've STOLEN from the citizens.

Communism: 100 years and counting, 100 million plus people viciously murdered!

The 2nd amendment is NOT DEBATABLE!!! It says: "shall not be infringed." Yet, people are working on how they can "infringe" something that says cannot be infringed.

Sure, there are crazy people out there. Duh! But this whole thing is leading up to "pre-crime." Which is RIDICULOUS.

When's the last time you saw "Minority Report?" Lot's of truth in that movie!

Also, when's the last time you saw "Red Dawn" (The old one.)

We are headed that way unless people wake up and see that SOCIALISM and COMMUNISM are the ENEMIES of freedom, and the constitution.

Yet, today, Socialists are gaining power in Washington.

Vladimir Lenin said it well: "The Goal of Socialism is Communism!"

Don't let them take away our GOD GIVEN RIGHTS! God help us!

I am looking for examples of abuse. Can you cite a case in point that I can follow up on? Thanks

    https://youtu.be/BsAhvXrhLiA

Kid takes classes on a college campus to finish his high school diploma. Regardless of backstory, he has discipline incidents that are resolved without further issue. One year later, father mentions the bogus allegations on FaceCrook, and coincidentally the Sheriffs arrive the next day.

Father gets arrested for "misusing 911" to verify the officers and report the fact they won't leave his property even though they don't have a warrant. He gets arrested for "obstruction" for telling his kid to wait for an attorney.

Is this a Red Flag "seize your guns" case? No.
Is this a Red Flag "activate the LEO because of a social media post" case? Most likely.

This guy got arrested for trying to protect his son.
This guy got arrested by pushy LEO who were there under false information.
These LEO wasted their time, harassed law-abiding citizens, and demonstrated exactly how easy it is for something to go wrong when everyone is so quick to pounce on a misunderstood comment.

If you dismiss this incident because it "wasn't about seizing guns", then you miss the point:
False information caused LEO to "investigate" unprofessionally enough to the point that a law-abiding citizen got arrested in front of his son and home for no good reason.

Who can't understand the rock-and-hardplace situation of the falsely-accused law-abiding Citizen?
Why would anyone support legislation that would make these kinds of interactions more common-place?

I’m against them, but they’re here whether we like it or not. So, Two things need included with red flag laws 1. A jury needs to decide if someone’s guns need taken away. Not a single person (Judge). That’s too much responsibility for one person. They’ll err on the side of safety every time out of fear.
    2. Severe Penalties need put in place for anyone who abuses the system. I.e. pissed off wife, or neighbor

I’ve forwarded my suggestions to Scott and Desantis. Don’t figure it’ll make any difference, but it’s my duty to try
